Buying in Las Vegas · Protecting your equity

Nevada protects $605,000 of your home equity. You have to file for it.

Nevada’s homestead law shields up to $605,000 of equity in your primary residence from most creditors. It does not apply on its own.

The short answer

  • Up to $605,000 of equity in the home you live in is protected from most judgment creditors.
  • It only applies once you record a Declaration of Homestead with the Clark County Recorder.
  • It is separate from the 3% tax cap. Filing one does nothing for the other.

01

What does the homestead protect?

Up to $605,000 of equity in the home you live in, against most judgment creditors. The amount has been the same since July 1, 2005, and Nevada’s 2025 legislative session left it unchanged.

It covers a house or a condo. If the home is held in a trust, moving it into the trust doesn’t cancel a declared homestead, and a trustee can declare one for the people living in it.

02

What doesn’t it protect?

  • Your mortgage or deed of trust.
  • Property taxes. Clark County’s own brochure says the homestead law does not exempt property tax.
  • IRS liens, mechanic’s liens, child support and alimony.
  • Equity above $605,000.

03

What about equity above $605,000?

That matters at the price points I work in. Here is an illustration.

A $3M HOMEMortgage$1.2MProtected$605KEquity not covered$1.195M
Illustration: a $3,000,000 home with a $1,200,000 mortgage. The homestead covers $605,000 of the $1,800,000 in equity.

If protecting the rest matters to you, that is a conversation for an asset protection attorney, and it is better had before you need it.

How do you file?

1
Get the form
From the Clark County homestead page.
2
Sign it before a notary
It describes the property and is recorded like a deed.
3
Record it
Clark County Recorder: 500 S. Grand Central Pkwy, 240 S. Water St. (Henderson) or 3211 N. Tenaya Way. Call 702-455-4336 for the current fee.

You can record it any time before the home is sold. There is no reason to wait.

Questions buyers ask

Is Nevada’s homestead protection automatic?

No. It applies once you record a Declaration of Homestead with the county.

How much does it protect?

Up to $605,000 of equity in your primary residence.

Does it lower my property tax?

No. Property tax is not exempt. The 3% tax cap is a separate program with its own form.

My home is held in a trust. Can I still file?

Yes. A trustee can declare a homestead for the people living in the home, and moving the home into a trust doesn’t cancel an existing one.
