The HOA resale package: the five days that protect you
When you buy a resale home in a Nevada HOA, the seller has to give you the association’s documents. Once you receive them, you have five days to walk away.

The short answer
- The seller pays for the resale package and delivers it to you.
- You can cancel in writing until midnight of the fifth calendar day after you receive it, and get your deposit back.
- The right can’t be waived. Nevada’s HOA law doesn’t allow it.
01
What is in the package?
- The governing documents: the declaration, bylaws, rules and the state information statement.
- What the seller owes the HOA, plus the monthly assessment.
- The budget and a current financial statement, including a summary of the reserves.
- Lawsuits and judgments against the association.
- Every fee tied to the sale, including transfer fees.
- All current and expected charges for the home: dues, assessments, fines and late charges.
02
Your five days
Nevada law lets you cancel the purchase by written notice until midnight of the fifth calendar day after you receive the resale package. Cancellation carries no penalty, and the money you paid is refunded promptly. The right ends once the home is conveyed to you.
Use the five days to read the money, not just the rules.

What to read first
04
What it costs and who pays
The seller pays. The law caps what the association can charge for the resale certificate, with an extra fee allowed for a rush. Other documents have to be provided electronically.
Buying new from the builder works differently. You receive a public offering statement, and the five-day cancellation runs from signing, unless you personally inspected the home.

Questions buyers ask
How long do I have to cancel after getting the HOA resale package in Nevada?
Until midnight of the fifth calendar day after you receive it, by written notice.
Who pays for the resale package?
The seller.
Can I waive the five-day right?
No. Nevada’s HOA law doesn’t allow buyers to waive the rights it gives them.
Does this apply to new construction?
New homes from the builder come with a public offering statement instead, with its own five-day cancellation from signing, unless you personally inspected the home.
