Can you rent your Las Vegas home nightly? Usually not, with a few exceptions.

If renting by the night matters to you, decide before you buy. City, county and HOA rules all have to allow it, and most of the time at least one of them doesn’t.

The short answer

  • In an HOA community, the documents must expressly allow it. Under Nevada law, silence means no.
  • The City of Las Vegas requires the owner to live in the home during the rental.
  • The exception is a handful of condo-hotels, such as Palms Place, Vdara, Signature at MGM Grand and Trump International. You don’t have to use the in-house program.

01

Three layers that all have to say yes

Where What it takes
Any HOA community The governing documents must expressly allow rentals for transient lodging.
City of Las Vegas Owner-occupied during the rental, a business license, and spacing from other rentals and resort hotels.
City of Henderson Annual registration and insurance. In an HOA, the documents must expressly allow it.
Unincorporated Clark County A license from a capped pool. Licensing has been held up by a federal lawsuit.

02

Why most luxury communities are out

Nevada’s 2021 short-term rental law says a rental can’t be authorized in a common-interest community unless its governing documents expressly allow transient lodging. Most guard-gated communities and high-rises don’t.

Longer leases are a different matter. Nevada law limits an HOA’s ability to ban ordinary leasing if the ban wasn’t in place when you bought. Many buildings set a minimum lease term, so check it.

03

The towers where nightly rentals work

A few high-rises are built as condo-hotels, with a hotel operating in the building. In these, owners can rent their units by the night.

  • The building’s hotel rental program, which handles bookings and housekeeping for a share of the income.
  • A third-party rental manager. Some of my clients have done well this way.
  • Renting it yourself, if the building’s rules allow it.
Tower Nightly rentals
Palms Place Yes
Vdara Yes
Signature at MGM Grand Yes
Trump International Yes
Waldorf Astoria No, even though it is a condo-hotel

The options, fees and rules differ by building. Read the rental program and the HOA rules before you buy, and remember that condo-hotels usually need a specialist lender.

04

Where the county stands

Clark County capped licenses at 1% of eligible homes in each unincorporated area and stopped taking applications in 2023. A federal court has since blocked parts of the ordinance, and the case is on appeal. The rules may change, which is a reason to buy on what you can count on today.

05

What to check before you buy

The HOA documents: do they expressly allow rentals under 30 days?
The minimum lease term, if you may rent long-term instead.
Which jurisdiction the home is in: City of Las Vegas, Henderson or unincorporated Clark County.
Whether the numbers work without nightly income.

Buy the home you want to own. Treat rental income as a bonus you have confirmed, never as part of the plan.

06

Questions buyers ask

Can I Airbnb my condo in Las Vegas?

Only if the building’s governing documents expressly allow transient lodging and the city or county allows it too. Most luxury buildings don’t.

Which Las Vegas condos can be rented nightly?

Condo-hotels such as Palms Place, Vdara, Signature at MGM Grand and Trump International. You can use the building’s rental program, a third-party manager, or rent it yourself where the rules allow. Waldorf Astoria doesn’t allow nightly rentals.

Does the City of Las Vegas allow short-term rentals?

Only owner-occupied rentals with a business license, plus spacing rules.

Can my HOA stop me from renting long-term?

Nevada law limits new rental bans for owners who bought before the ban, but buildings can set rules such as minimum lease terms. Read the documents.
