Buying a new-construction home in Las Vegas: what the builder won’t tell you first

Don’t walk into a builder’s sales office without your Realtor. After that first visit, you may not be able to bring one.

The short answer

  • Take your Realtor to the first visit. Builders often decide representation at that visit.
  • There are few of the usual contingencies, and once your deposit is in, it is very hard to get back.
  • Closing dates move. Expect up to three to six months either side of the date you’re given.

01

Why the first visit matters most

Builders generally require your agent to register you at, or be with you on, your first visit to a community. Toll Brothers and Lennar both publish rules like this. Walk in alone and you may lose the chance to be represented for that community.

Never go to a new home site without your Realtor.

02

How a builder contract is different

  Resale New construction
Loan contingency Usually Usually not
Appraisal contingency Usually Usually not
Due diligence period Yes Usually not
Deposit Protected by contingencies Very hard to get back once it is in

The builder writes the contract, and it protects the builder. Read it with that in mind, and have an attorney review it if the deposit is large.

03

Why the closing date moves

The timeline you get when you go under contract is rarely what happens in the end. Expect as much as three to six months sooner or later than the projected closing date.

That gap carries a second risk. If the market slows before you close, the appraisal can come in low at the end, and without an appraisal contingency the difference is yours to cover.

04

Where I’ve done this

My highest sale, $2,357,345, was a new Shawood home in Summerlin. The work was done before the contract: knowing which terms the builder would move on and which it wouldn’t.

05

Questions buyers ask

Do I need a Realtor on my first visit to a builder?

Yes. Builders often decide representation at the first visit. Bring your agent or register them before you go.

Can I get my deposit back on a new build?

Usually only in limited situations. Once it is in, plan on it being committed.

How accurate is the builder’s closing date?

It often moves. Expect up to three to six months either way.

Is there an appraisal contingency on new construction?

Usually not. If the appraisal comes in low, you may have to cover the gap.
